🏠 It's YOUR Property… But Can You Actually Get It Back When You Need To? πŸ”‘

Imagine this. You've invested your savings into a rental property. You've maintained it, paid the mortgage and done everything expected of you as a landlord. 🏑 Then your circumstances change. πŸ”„

Perhaps you need to sell. Maybe you want to move back into the property. Or, worse still, your tenant has stopped paying rent. πŸ’·βš οΈ
Surely, as the owner, you can simply ask for your property back?

Unfortunately, it's no longer that simple. βš–οΈ

🚨 Section 21 is gone. What does that mean for you?

Since 1 May 2026, landlords have no longer been able to use Section 21 to end a tenancy without providing a legal reason. πŸ“„

Instead, landlords must rely on the appropriate grounds under Section 8. βš–οΈ

There are still legitimate reasons to regain possession, including:

🏷️ Selling your rental property.
🏠 Moving into the property yourself or housing certain family members.
πŸ’· Serious rent arrears.
⚠️ Certain types of anti-social behaviour or tenancy breaches.

However, each ground comes with specific legal requirements, notice periods and conditions. πŸ“‹

🏑 Thinking of selling? Plan ahead!

If you intend to sell your rental property, you can no longer simply issue a Section 21 notice.

Under the new rules, the selling ground generally requires four months' notice and cannot be used during the first 12 months of a new tenancy. πŸ“…

That means planning ahead is more important than ever. ⏳

And if your tenant doesn't leave when the notice expires? You may need to apply to court for possession. βš–οΈ

πŸ’· What if your tenant stops paying rent?

This is understandably one of landlords' biggest worries. 😟

Under the revised mandatory rent arrears ground, a tenant must generally owe at least three months' rent both when notice is served and at the possession hearing.

The notice period for this ground is four weeks. πŸ“„

But remember, a notice is not the same as getting your property back. πŸ”‘

If your tenant doesn't leave, further legal proceedings may be required. βš–οΈ

Meanwhile, your mortgage, insurance and maintenance costs don't simply disappear. πŸ πŸ’Έ

πŸ“Š Could you afford months without rental income?

It's a question every landlord should ask themselves. πŸ€”

If your tenant stopped paying tomorrow, how long could you comfortably cover the costs?

One month? Three months? Six months? πŸ’·
