CASE 1
This property was in Riverview Park in Gravesend, a DA12 postcode. Any hearing in this area is heard at Dartford Court. The landlord was serving a Section 21 notice due to persistent rent arrears π

- 15/12/2022 - Section 21 notice served
- 22/02/2023 β Section 21 notice expired
- 25/02/2023 β Solicitors notified that tenant did not vacate
- 27/06/2023 β Received confirmation of a court hearing for 18th July 2023
- 18/07/2023 β Possession order granted at court hearing β tenants have to vacate by 01/08/2023
- 01/08/2023 β Tenant did not vacate on 01st August as per order
- 03/08/2023 β Solicitors apply to court for a bailiff date
- 31/08/2023 β Bailiff date confirmed as 29th September 2023
- 29/09/2023 β Meet bailiff at property. Vacant possession achieved ππ
CASE 2
This property was in Hever Farm in Gravesend, a DA12 postcode. Any hearing in this area is heard at Dartford Court. The landlord was serving a Section 21 notice as they needed to sell the property π . The tenant looked after the property well and there were no rent arrears.
In total, the possession took 9 months!! Hereβs how β¦
- 15/4/2023 - Section 21 served
- 25/06/2023 - Section 21 notice expired
- 03/07/2023 - Solicitors notified that tenant did not vacate
- 30/08/2023 β Received accelerated possession order for signing from solicitor (an accelerated order can be used if there are no rent arrears)
- 12/10/2023 β Received confirmation from the court that tenant has until 17th October to file any response to the claim, failing which we can then ask the court to draw up the order for possession
- 17/10/2023 β Tenant did not vacate on 17th October as per order
- 12/12/2023 β Solicitors chased the court for confirmation that the Order for Possession has been drawn up
- 19/12/2023 - Received Order for Possession BUT the order included a hearing date for Friday 22/12/23 as tenant has put forward a defence
- 22/12/2023 β Solicitors attend court. The only discussion to be had with the judge is if extra time is warranted due to exceptional hardship. Possession date delayed until 19/01/2023
- 20/01/2023 - Solicitors notified that tenant did not vacate on 19th January as per order
- 22/01/2024 β Solicitors apply to court for a bailiff date
- 1/03/2024 - Bailiff date confirmed as 18th March 2024
- 18/03/2024 - Meet bailiff at property. Vacant possession achieved ππ
Whilst itβs worth noting that timescales can vary considerably β±οΈ, itβs interesting that both possessions took around 9 months.
We recommend all our managed landlords take out our rent guarantee insurance and thankfully in both of these cases the landlords had insurance in place π. This meant that all court costs and solicitors costs were covered as well as rent arrears, with no excess on the policy.
